RITE COUNTERS ELIAS IN OHIO, SEEKS EARLY DISMISSAL OF PHOTO ID CHALLENGE

Working with RITE, two Ohio citizens and the Ohio GOP are asking an Ohio federal court to preemptively dismiss Marc Elias’ frivolous challenge to the state’s new election integrity safeguards.

DEREK LYONS:

“The Elias case is a shallow attempt to advance a partisan agenda. The U.S. Constitution clearly supports states setting the parameters for their elections and enforcing reasonable regulations that advance its interests is administering free and fair elections that promote citizens’ confidence in their integrity. We are asking the judge to review the existing precedents that widely support similar safeguards and dismiss this challenge for what it is, a political stunt.”

Ohio Secretary of State Frank LaRose is preparing a vigorous defense of H.B. 458, the new election integrity reforms signed into law by Governor DeWine in January 2023. RITE supports these efforts but is also arguing that Elias’ initial claims fall so short of proving any harm that the judge should dismiss them before they waste any further taxpayer time and resources.

Andrew C. McCarthy

Bobby Burchfield

Bobby R. Burchfield is a co-founder, with Karl Rove, of Restoring Integrity and Trust in Elections, Inc., and currently serves as RITE’s Chairman. Before retiring from the practice of law in March 2021, after serving as a partner in three international law firms, Bobby was a trial and appellate  lawyer who tried cases before judges and juries and argued appeals throughout the United States. His cases addressed a broad  range of subjects  including antitrust, commercial  disputes, constitutional law,  election law, and class action issues. Bobby argued two important First Amendment cases

in the Supreme Court of the United States (McConnell v. FEC and McCutcheon v. FEC), as well as two dozen appeals in the lower courts. Over a 40-year career, Bobby never lost a jury trial. Among other recognitions, he was listed for many years in Best Lawyers in America, and Chambers Partners rated Bobby highly for Commercial Litigation and for Election Law.
