(Harrisburg, PA – February 27, 2025) – Restoring Integrity and Trust in Elections (“RITE”), a non-profit organization that supports litigation to protect election security and integrity, has filed an amicus brief with the Pennsylvania Supreme Court to support the rule of law and the integrity of the Commonwealth’s elections. RITE partnered with the Honest Elections Project on the filing to oppose an attempt to invalidate the requirement that voters provide a proper date on their absentee ballot envelope. The case, Baxter v. Philadelphia Board of Elections, is yet another assault on common sense from left-wing activists who are determined to undermine the security of our elections.
The Supreme Court is set to hear the case following an appeal by the Republican National Committee and Republican Party of Pennsylvania of a ruling by the state’s Commonwealth Court that invalidated the dating requirement on the basis it violated the state constitution’s Free and Equal Elections Clause. RITE’s brief explains that the Commonwealth Court’s decision should be thrown out because it usurped the Supreme Court’s exclusive jurisdiction to hear constitutional challenges to election laws. RITE also explains that the dating requirement is entirely consistent with the Free and Equal Elections Clause which defers to the state legislature in deciding ballot-counting rules and which Pennsylvania courts have never used to invalidate a neutral, generally-applicable ballot-casting rule.
RITE has been heavily engaged in the endless litigation surrounding dated ballot envelopes. It sponsored litigation leading up to the 2022 Election which resulted in a landmark state Supreme Court ruling that the dating requirement was mandatory and ensured it was in effect for that election. RITE also filed a brief in the present case at an earlier stage of the litigation, helping ensure the dating requirement was in effect for the 2024 Election. Finally, RITE was active in litigation that resulted in a pivotal federal appellate court ruling finding the dating requirement to be consistent with federal voting rights laws.
