WASHINGTON, DC – Restoring Integrity and Trust in Elections (“RITE”) and Representative Claudia Tenney (NY-24) have written to the New York State Board of Elections (“NYSBOE”) demanding records that will uncover the full sweep of the state’s violations of the federal Help America Vote Act (“HAVA”), after previously calling on the state to correct those violations.
In a November 2025 letter, RITE identified two independent HAVA compliance failures and urged NYSBOE to take corrective action. First, New York’s voter registration form did not clearly instruct applicants that they must provide a driver’s license if they have one. Second, a New York regulation instructed county officials to register individuals who failed to provide either a Driver’s License or partial Social Security number on their registration form, even when the applicant did not affirm that they possessed neither.
Following RITE’s letter, NYSBOE revised its voter registration form to better reflect HAVA’s identification requirements. But the more serious issue remains unresolved. NYSBOE has not addressed the regulation requiring counties to register applicants who fail to provide any identifying number nor affirm that they possess neither, nor has it responded to RITE’s request for an audit quantifying how many such registrations have been accepted. A previous investigation by an allied organization revealed that as many as 3.1 million registered New York voters are missing the required numbers.
The new records request, submitted pursuant to Section 8(i) of the National Voter Registration Act (“NVRA”), seeks comprehensive data and internal records related to New York’s voter registration system.
“As Chair of the Election Integrity Caucus, I remain deeply concerned that New York continues to fall short of its obligations under federal election law, especially after I called for an investigation into these issues in 2022,” said Congresswoman Claudia Tenney. “Transparency and accurate voter rolls are essential to maintaining public trust in our elections. The people of New York deserve answers, accountability, and full compliance with HAVA to ensure the integrity of every vote.”
“The law is clear: states may not accept registration forms that lack required identifying information,” said RITE President Justin Riemer. “New York’s own regulations direct officials to do exactly that. This flagrant violation of an important federal safeguard significantly erodes the integrity of New York’s voter registration system. We are committed to getting answers about the breadth of the problem and ensuring the state fixes it.”
The letter requests production of the records by May 7, 2026. If New York fails to comply, RITE and Rep. Tenney are prepared to pursue enforcement in federal court.
