Republican Party organizations supported by RITE PAC sued Arizona Secretary of State Adrian Fontes for improperly promulgating unlawful regulations in the 2023 Elections Procedures Manual (EPM). Fontes violated the Arizona Administrative Procedures Act (APA) by providing only a 15-day comment period for a 259-page draft, far shorter than the required 30 days, and adding critical provisions without public notice. Additionally, several provisions of the EPM contradict specific Arizona statutes, particularly concerning voter eligibility. These include rules that let previously submitted documentary proof of citizenship (DPOC) be used to skip over juror non-residency checks; allowing federal-only voters to cast ballots in presidential elections without DPOC; letting county recorders off the hook for checking voter registrations against national databases; restricting public access to voter signatures; and allowing ballots to be mailed out-of-state for the Active Early Voting List (AEVL). These rules go beyond the Secretary’s authority and Plaintiffs ask the court to declare them invalid and block their enforcement.
Plaintiffs filed their complaint on February 9, 2024. On May 10, the trial court dismissed the case. Plaintiffs appealed, and the Arizona Court of Appeals heard oral argument on December 10.
On March 6, 2025, the Arizona Court of Appeals reversed the trial court, determining that the Secretary violated the APA, and remanded for further proceedings consistent with this decision. Secretary Fontes filed a petition for review in the Arizona Supreme Court on April 7, and Plaintiffs filed a response on May 7. On September 8, Plaintiffs and the Secretary filed supplemental briefs in the Arizona Supreme Court.
On October 16, the Arizona Supreme Court held that the APA does not apply to the EPM, and reversed the 8 alternative claims to the Court of Appeals. On December 5, the Court of Appeals held that the RNC lacked standing, and dismissed the complaint.
