League of Women Voters v. Schwab (RITE)

The League of Women Voters, backed by left-wing activist lawyer Marc Elias, sued Kansas in an effort to make elections less secure. Their lawsuit attacked laws requiring basic signature verification to validate absentee ballots and limiting ballot trafficking—commonsense measures designed to ensure that only eligible voters participate and that ballots are handled safely. RITE argued that the Kansas Constitution creates no right to unfettered mail ballot voting, and furthermore grants the state legislature broad discretion to prescribe proof of eligibility. The law is clear: these measures are well within the state’s power to protect election integrity.

On May 31, 2024, the Kansas Supreme Court dismissed the challenge to the ballot harvesting provision and returned the signature verification issue to the trial court for further analysis.

On remand, the trial court permanently enjoined the ballot-application “false representation” provision on December 13, 2024, and on March 27, 2025 denied the defendants’ motion to dismiss the signature-verification claim. After cross-motions for summary judgment, the court held a trial from July 20 to 24, 2026 on the signature-verification provision. A decision is pending.

Bobby Burchfield

Bobby R. Burchfield is a co-founder, with Karl Rove, of Restoring Integrity and Trust in Elections, Inc., and currently serves as RITE’s Chairman. Before retiring from the practice of law in March 2021, after serving as a partner in three international law firms, Bobby was a trial and appellate  lawyer who tried cases before judges and juries and argued appeals throughout the United States. His cases addressed a broad  range of subjects  including antitrust, commercial  disputes, constitutional law,  election law, and class action issues. Bobby argued two important First Amendment cases

in the Supreme Court of the United States (McConnell v. FEC and McCutcheon v. FEC), as well as two dozen appeals in the lower courts. Over a 40-year career, Bobby never lost a jury trial. Among other recognitions, he was listed for many years in Best Lawyers in America, and Chambers Partners rated Bobby highly for Commercial Litigation and for Election Law.
