A labor union, represented by left-wing activist lawyer Marc Elias, challenged Georgia’s entirely reasonable absentee ballot request deadline as a civil rights violation . This argument ignores that Georgia’s deadline—set at eleven days before the election—protects the right to vote by ensuring that ballots arrive with enough time to be returned and counted before the election closes. RITE PAC, moreover, argued that the plaintiffs’ case isn’t just misguided, but also that striking down Georgia’s deadline would be unconstitutional. Section 202 of the Voting Rights Act, on the basis for plaintiffs’ case, cannot override state election laws governing presidential elections.
On June 13, 2024, the district court dismissed some of the defendants and Georgia’s deadline was in effect for the 2024 election. Litigation remains ongoing with respect to the remaining defendants.
