U.S. District Court for the Northern District of Illinois
This lawsuit challenges an Illinois statute permitting ballots to be returned and counted up to two weeks after Election Day. Plaintiffs argue that this violates the federal Election Day statute requiring states to hold elections on the first Tuesday in November.
On July 26, 2023, a district court dismissed the case on standing grounds. On August 21, 2024, the Seventh Circuit affirmed the district court’s decision.
On November 19, plaintiffs petitioned the U.S. Supreme Court for review, which was granted on June 2, 2025. On October 8, the U.S. Supreme Court heard oral arguments.
On January 14, 2026, the Supreme Court granted judgment in favor of Bost.
