RITE challenged the City of Burlington’s new charter provision allowing noncitizens to vote in school board races and school budget referenda. These education-related votes are not purely municipal matters but are fundamentally tied to state funding and policy. The Vermont Constitution limits the right to vote on matters “that concern the State of Vermont” to U.S. citizens. Burlington’s school budget is funded largely through the statewide Education Fund, meaning votes on the school budget have statewide financial implications. Allowing noncitizens to cast ballots in such elections dilutes the votes of eligible voters and violates the state constitution.
On February 7, 2025, the trial court dismissed the case. RITE appealed to the Vermont Supreme Court.
