Washington, D.C. – Today, the Pennsylvania Supreme Court agreed to review a petition filed by Restoring Integrity and Trust in Elections (“RITE”) on behalf of several concerned voters seeking to enforce state election law regarding undated and incorrectly dated mail-in ballots. As RITE explained in its petition, the Pennsylvania Secretary of Commonwealth recently defied state and federal law by instructing local election officials to count undated and incorrectly dated ballots. Left unchallenged, the Secretary’s unlawful instructions would skew the results of the upcoming November election and harm the integrity of future elections. Now, the Court has an opportunity to resolve this critical issue before the election.

RITE is pleased with the Court’s decision to review its petition. The law of the Commonwealth is clear that undated and incorrectly dated mail-in ballots must not be counted. Hopefully, the Court takes this opportunity to properly instruct Pennsylvania officials how to comply with the law and eliminate any doubt about whether unlawful ballots should count. RITE looks forward to briefing this issue before the Court.
