RITE FILES PETITION WITH PENNSYLVANIA SUPREME COURT TO STOP STATE OFFICIALS FROM VIOLATING ELECTION CODE

Washington, D.C. – Restoring Integrity and Trust in Elections (“RITE”) is supporting several
concerned voters who have filed a petition with the Pennsylvania Supreme Court to enforce state election law regarding undated and incorrectly dated mail-in ballots. The Pennsylvania Supreme Court has already held that state law prohibits counting these ballots. And just last week, the U.S. Supreme Court invalidated a court ruling that had interpreted federal law to require them to be counted. Despite these rulings, the Pennsylvania Secretary of the Commonwealth responded by instructing election officials that both state and federal law still requires them to count undated and incorrectly dated mail-in ballots.

RITE is filing this petition to prevent Pennsylvania bureaucrats from flouting the law and to
keep them accountable for administering fair elections across the Commonwealth. 

Derek Lyons, RITE’s President and CEO, issued the following statement:

RITE is proud to support Pennsylvania voters in their effort to ensure their elections are conducted in accordance with the rule of law. The law of the Commonwealth is clear that undated and incorrectly dated mail-in ballots must not be counted. And after the U.S. Supreme Court’s action last week, no federal law says otherwise. When voters cast a ballot, they should be confident that election officials are protecting the integrity of elections, not abusing their discretion to chase partisan outcomes.

Andrew C. McCarthy

Bobby Burchfield

Bobby R. Burchfield is a co-founder, with Karl Rove, of Restoring Integrity and Trust in Elections, Inc., and currently serves as RITE’s Chairman. Before retiring from the practice of law in March 2021, after serving as a partner in three international law firms, Bobby was a trial and appellate  lawyer who tried cases before judges and juries and argued appeals throughout the United States. His cases addressed a broad  range of subjects  including antitrust, commercial  disputes, constitutional law,  election law, and class action issues. Bobby argued two important First Amendment cases

in the Supreme Court of the United States (McConnell v. FEC and McCutcheon v. FEC), as well as two dozen appeals in the lower courts. Over a 40-year career, Bobby never lost a jury trial. Among other recognitions, he was listed for many years in Best Lawyers in America, and Chambers Partners rated Bobby highly for Commercial Litigation and for Election Law.
